Donald Klapper,1733 Cove Circle Eastissued a “stop work order” regarding sidewalk put in down to the lake.
Gordon Weis,1753 Cove Circle East issued a “stop work order” regarding sidewalk placed parallel to the lake, committee requested this be removed and completed with rip-rap installed as originally agreed upon by previous meeting with Mr. Weis,
Copy from March 7 2018minutes: Gordon Weis, Lot# 2537/2538A, 1753 Cove Circle East, Requesting 10′ Variance to place a retaining wall located on the property line. The variance is for constructing a landscape retaining wall starting at the property line between lots 2538A and 2538B. The wall will be constructed a minimum of six feet from the rear property line. The wall will be an Alan Block wall with concrete footer located as shown in the drawing provided. The top of the Base footer of the wall and the grade leading up to the wall must be a minimum 12” above the level of the summer pool. The opposite end of the new wall must be no closer than a minimum of 12 feet from the rear property line. The Committee recommends the Variance for POA approval if the construction is accomplished according to specifications.
Mr. Weis was asked to come in after the June 6th meeting to fill out another permit and drawing for another retaining wall.

Chad & Melissa Wiseman, Lot # 2202/2203H, 1426 Kym Court, Discuss placement of shed that was built on property without permit. The Wisemans will move shed 5 ft. to within the allowable buildable area of property. The Wisemans are to come in and submit a permit and drawings on their plot plan.

Discuss Rules on retaining walls and property being surveyed
Regarding required survey prior to “lot clearing”:
4-5-11. Plot Plans Require an Indiana Registered Surveyor
- In order that all the required plot plan information be properly documented and correctly designated, it is necessary that all plot plans must be approved by an Indiana registered surveyor.
- The building location shall be staked out on the lot by a registered Indiana surveyor before plot plans are submitted to the HVL POA Architecture Committee. Lot corners, front of the house, rear of the house, and offsets from property lines and other such points shall be staked by an Indiana registered surveyor to indicate the location of the house.
4-29-8. Retaining wall exceptions.
- Retaining walls outside the buildable portion of a lot may be approved by the Architectural Committee if the Committee deems it is necessary for ascetics and usability of the property.
- These wall must be section type walls and textured.
- Walls must be removable in the event a utility needs access.

Lot corners, front of the house, rear of the house, and offsets from property lines and other such points shall be staked by an Indiana registered surveyor to indicate the location of the house.

- In order that all the required plot plan information be properly documented and correctly designated, it is necessary that all plot plans must be approved by an Indiana registered surveyor.
- The building location shall be staked out on the lot by a registered Indiana surveyor before plot plans are submitted to the HVL POA Architecture Committee. Lot corners, front of the house, rear of the house, and offsets from property lines and other such points shall be staked by an Indiana registered surveyor to indicate the location of the house.
The committee concluded that if the landowner stakes the corners of the property line in accordance to the previous survey stakes with accurate measurements, this should suffice. The adjacent property owners should be protected from any disturbance of vegetation on their property, if there is an occurrence, if infringement on neighboring property occurs, HVL would not be involved is this issue.
Regarding retaining walls outside of approved parameters:
4-19-8. Retaining wall exceptions.
- Retaining walls outside the buildable portion of a lot may be approved by the Architectural Committee if the Committee deems it is necessary for ascetics and usability of the property.
- These wall must be section type walls and textured.
- Walls must be removable in the event a utility needs access.
The committee came to the conclusion: On walls outside of approved parameters committee will review and homeowner will request ‘variances’ for those walls needed for retention of lot/building, etc. While still adhering to other existing rules and recommendations.
